Historically, the National radioactive waste management Agency (Andra) was created within the Atomic Energy Commission (CEA) by a November 7 1979 order.

Article 13 of the December 30 1991 Waste Act No. 91-1381 related to research on the management of radioactive waste, that became article L.542-12 in the Environment Code, made the Andra independent of the CEA by transforming it into a public industrial and commercial establishment (French acronym EPIC) responsible for long term management of radioactive waste, under the authority of the Ministries for Energy, Research and Environment.

In this respect two important acts were promulgated in 2006 :

• the “Transparency and Security in the nuclear field Act ” (June 13th 2006), sometimes called TSN Act and available in English.
• the "Planning Act on the sustainable management of radioactive materials and waste " (June 28th 2006). The articles of this 2006 Planning Act, which is notably dedicated to the fuel cycle back-end and radioactive waste management than the TSN Act, are now part of the Code of Environment. This Act is available in English.
